JUST SOCCER FC LLC RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY, EMERGENCY/MEDICAL RELEASE, AND PARENTAL CONSENT AGREEMENT

IN CONSIDERATION of being permitted to participate in any way in the Just Soccer FC LLC activity (“Activity”) I, for myself for personal representatives, assigns, heirs, and next of kin:

• ACKNOWLEDGE, agree, and represent that I understand the nature of Just Soccer LLC Activities and that I am qualified, in good health, and in proper physical condition to participate in such Activity.  I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the Activity.  

• FULLY UNDERSTAND THAT:  (a) Just Soccer FC LLC ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH (“RISKS”); (b) these Risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participation in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF THE “RELEASEES” NAMED BELOW; (c) I understand the hardness of the playing surfaces and non-padded walls, the different and unique characteristics of sports tile when wet and dry (as opposed to grass), and the roughness of the sport; (d) there may be OTHER RISK AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation or that of the minor in the Activity.  

• HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE Just Soccer FC LLC, their respective administrators, directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers, and if applicable, owner, lessors and lessees of premises on which the Activity takes place, (each considered one of the “RELEASEES” herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE “RELEASEES” OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the Releasee’s, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim.  

• Just Soccer FC LLC, has a zero tolerance for fighting policy. Fighting is strictly prohibited and failure to comply with this policy will result in an immediate ejection from the facility and a further ban from the facility.  Incidents may also be reported to the Corona Police Department and criminal charges may follow.

MINOR RELEASE

This is to certify that I, as Parent, Guardian, Temporary Guardian with legal responsibility for this participant, do consent and agree not only to his/her release of all Releasee’s, but also to release and indemnify the Releasee’s from any and all liabilities incident to his/her involvement in these programs for myself, my heirs, assigns, and next of kin. This release shall be binding to the fullest extent permitted by law.  If any provision of this release is found to be unenforceable, the remaining terms shall be enforceable. 

 I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, I FULLY UNDERSTAND ITS TERMS, I UNDERSTAND THAT I HAVE GIVEN UP LEGAL RIGHTS BY SIGNING IT, AND I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
